Cube scarcity condition question?

I tried to overbuild a level 3 coalmine over a level 2 coalmine(that wasn't flipped) and it gave me this message. None of the coal mines were connected to a port as these are our first turns and first built tiles:

You cannot currently build over an opponent's Coal Mine: the cube scarcity condition is not satisfied.

What is the cube scarcity condition for canal era? is it different for rail era?

Same for both phases: you can only build over coal mines if yours is higher level, the coal track is emptied out AND there is no coal on the board from unflipped mines.

You will never see coal mine overbuild in the Canal Phase though.

You can build over your own coal mines at anytime though as long as it's higher level (as with all industries). An that's sometimes viable in Canal phase, so scratch my last sentence.
